Sky Dispute: FlightAware Sues Kalshi for Unauthorized Use of Brand and Betting Data

FlightAware, long known for providing up-to-date information on aircraft locations, flight delays, and cancellations to airlines, pilots, and travelers worldwide, has filed a lawsuit against Kalshi. According to the lawsuit, Kalshi, according to the plaintiff, created several marketplaces where participants could bet on specific flight cancellations, using data from the FlightAware platform as the primary source of information. FlightAware believes such actions are a direct violation of its terms of use, which strictly prohibit any commercial use of data obtained from FlightAware's website without express written permission.

FlightAware's primary complaint concerns not only the unauthorized access to data but also the way Kalshi presented this information. FlightAware alleges that Kalshi used its trademark and service name on its pages, misleading users into believing that there was an official partnership or coordinated collaboration between the companies. According to the plaintiff, this caused significant damage to FlightAware's reputation, as outside observers could mistakenly perceive it as a gambling operation rather than a neutral information provider. Notably, a disclaimer denying any connection with FlightAware appeared on Kalshi's website only after FlightAware sent an official notice demanding Kalshi cease and desist.

The legal issues don't end there. FlightAware is concerned that the existence of a marketplace for betting on flight cancellations could create incentives for unfair practices. Although Kalshi claims to have internal policies prohibiting payments under suspicious circumstances, the lawsuit emphasizes that the mere financial interest in changing flight status could potentially provoke attempts to interfere with aviation operations. The lawsuit cites public concerns that such markets could encourage unsafe practices that endanger passengers and could lead to widespread disruption to the air travel system. Furthermore, FlightAware notes that its own reputation has already suffered from unfounded allegations of complicity in betting, which are completely untrue and cause further reputational damage.

As a legal remedy, FlightAware is requesting a preliminary injunction requiring Kalshi to immediately cease using the plaintiff's data and trademarks. The plaintiff also seeks monetary compensation, the exact amount of which has not yet been determined and will be determined during the trial. At the time of writing, Kalshi's press service declined to comment officially, which may be part of a standard legal strategy or a sign that a more detailed response is being prepared.

It's worth noting that this lawsuit isn't the first instance of legal pressure against Kalshi in the US. Music streaming service Spotify previously filed a complaint accusing the platform of attempting to manipulate charts through similar forecast contracts. Despite these legal proceedings, Kalshi's trading volumes continue to grow, indicating continued user interest in such financial instruments.
